I think the reason he and most other attorneys will say that Mueller won't indict Trump is this:

• Can We Indict a Sitting President?
  
• A Sitting President's Amenability to Indictment and Criminal Prosecution
  
• US Presidents Are Not Immune From Criminal Prosecution
  
• The Law as King and the King as Law: Is a President Immune from Criminal Prosecution Before Impeachment?

Reading those papers, and without regard to politics, there is ample basis for thinking a POTUS can or cannot be indicted/prosecuted. Speculation one way or the other on whether the current POTUS will or won't be indicted and prosecuted likely is better informed by knowing the mindset of the jurists who would likely be called to decide whether such a thing is permissible than it is by knowing the current body of case law on the matter.
