The Senate has already impeached and tried an office holder, the secretary of war, after he no longer held the seat.

He was not the president, the constitution specifically enumerates the president and assigns him special powers and privileges and this conviction will be fought fiercely, especially when the charge is specious and gratuitous. There was no insurrection, not even the people actually ARRESTED there are being charged as such and Trump had no hand, conscious or otherwise in directing them.

Every American is granted due process in a criminal trial, because their freedom can be taken from them, by incarceration.

Impeachment can not strip freedom. It's a political process.

None the less, President Trump, during his trial will get his due process....He can testify on his own behalf, his law team can call witnesses, and question any witness the House Managers present, they can present evidence on TRUMPs behalf to counter the accusations etc etc etc....

And the second, separate vote required, which only requires a majority vote, not the 2/3s vote, is whether or not to strip those impeached, from ever holding office again.

You can't vote to strip him from holding office again, without the impeachment trial, and that vote cast...

Thus, his holding office or not, matters naught....
Pelosi, or Schumer has no right to tell us who we can vote for.

All those cases that dems remind trumpets they lost in court were not fraud cases, but election law procedural issues... and they brought the same procedural issues to as many as ten states, losing in all of them, because the relief they were asking in every one of those cases, was to invalidate ALL absentee ballots in a county with a big city, and mostly minority voters, legally and constitutionally granted the rig h t to vote...because a handful of absentee ballot envelopes May have had a signature not checked, and things like that...and the case Judges basically said, ARE YOU CRAZY? to the Trump lawyers.

No cases of vote switching, or Dominion voting machine irregularities, or milktary swat teams capturing voter servers in Germany, or ballot stuffing, or any of the accusations made by Giuliani and team, in your right wing media was brought to court, by Giuliani and team....not one....ask yourself why not even one?

My bet is the law teams know if they presented a known bogus claim to the court, they could lose their law licences or censured in the least.

Trump was not a private citizen when he was impeached, that's an obvious FACT.

The senate holds the trial for those people impeached.

Nothing in the constitution suggests somebody can escape by running out the clock.

All those cases that dems remind trumpets they lost in court were not fraud cases, but election law procedural issues... and they brought the same procedural issues to as many as ten states, losing in all of them, because the relief they were asking in every one of those cases, was to invalidate ALL absentee ballots in a county with a big city, and mostly minority voters, legally and constitutionally granted the rig h t to vote...because a handful of absentee ballot envelopes May have had a signature not checked, and things like that...and the case Judges basically said, ARE YOU CRAZY? to the Trump lawyers.

No cases of vote switching, or Dominion voting machine irregularities, or milktary swat teams capturing voter servers in Germany, or ballot stuffing, or any of the accusations made by Giuliani and team, in your right wing media was brought to court, by Giuliani and team....not one....ask yourself why not even one?

My bet is the law teams know if they presented a known bogus claim to the court, they could lose their law licences or censured in the least.

Public or private citizen?
Trump was not a private citizen when he was impeached, that's an obvious FACT.

The senate holds the trial for those people impeached.

Nothing in the constitution suggests somebody can escape by running out the clock.
Can the Senate now, going forward, hold impeachment proceedings for any former official? Point that out please in the constitution

Biden won and is the President living in the WH. Trump was impeached for a second time and his trial will begin in the Senate in two weeks. USMB Trump fans are in denial and delusional.
I think history will judge both Democrat led Kangaroo proceedings for what they are, a shameful display of contempt, and over reach.

Not only can the senate try a private citizen, they have.



On Thursday, February 1, 1934, Black’s committee issued a subpoena forMcCracken’s records regarding the air mail contracts. MacCracken refused to produce files,
citing attorney-client privilege unless his clients waived the privilege. Black argued that MacCracken represented the airline industry more as a lobbyist, not an attorney, and therefore he could not claim attorney-client privilege. When McCracken did not turn over the documents,
Black held him in contempt of Congress and ordered Senate sergeant at arm Chesley Jurney toarrest him.

The Senate quickly adopted a resolution ordering MacCracken to be arrested and brought
before the bar of the Senate for trial.


With MacCracken officially under Senate arrest,
O’Donoghue immediately issued a second writ of habeas corpus. As long as MacCracken was in
the Senate chamber, however, the writ could not be delivered.
The Senate immediately began the trial of MacCracken and his co-defendants on Monday afternoon.

When the trial resumed on February 14, Hogan argued that the charges against his client
be dropped. He claimed the Senate did not have jurisdiction to try and convict his client because
MacCracken had purged himself of all charges when he turned over the required documents to Congress.

The Senate handed down its decision in open session on February 15.

It found MacCracken and Brittin guilty of contempt of Congress and acquitted Hanshue and Givvin. The
votes to convict MacCracken and Brittin followed party lines with most republicans voting in
favor of convictions and all Democrats and progressive Republicans voting against. The Senate
sentenced MacCracken and Brittin to 10 days in the District of Columbia jail.

The house can only impeach officers of the US. So a former official would not be subject to impeachment.

But remember, that's a bar on impeachment, not a bar on the senate trying the impeachments presented to it.

Clinton wasn't impeached for lying to Congress, he was impeached for not admitting to getting a blow job in a civil case that was dismissed as having no merit.

Bill Clinton was found Guilty of Contempt of Court in a civil case in which he was being sued for Sexual Harassment. The Judge ruled him to be in Contempt of Court for being DISHONEST and for ATTEMPTING TO MISLEAD THE COURT, JURY, AND JUDGE.

For his crime he was publicly rebuked and was stripped of his license to practice law in Arkansas.

The sexual predator and pedophile took an oath to protect and defend the Constitution and Constitutional Rights of Americans, but that day in court President Clinton attempted to deny the plaintiff a fair and honest trial by lying his ass off and attempting to mislead the court.

It was for this violation of his oath and the breach of trust with the American people that he was Impeached.

As far as the court case, it was NOT dropped for 'lack of merit'. After his actions the case was tossed - a new trial was probably going to follow. So, Slick Willy PAID HER OFF - PAID HER TO GO AWAY.

Ok, so you agree that the house process was irregular. Now, show me where a private citizen can be tried by the Senate. Also, if it is an impeachment trial, why isn’t the Chief Justice going to be the presiding officer, and what is the punishment on conviction.
A former office holder, VP, or president can be impeached, not for things done after leaving office or as a private citizen, but for what they did while sitting in office.

We have done it before a couple of times... the latest was in 2010, for a former federal judge. And Also, we impeached and tried a former Secretary of War, William Belknap.

In 2010, when former federal Judge Thomas Porteous was impeached, Senate President Pro Tempore Daniel Inouye presided over the trial.



- the Chief justice, I just read in a fact check, was never even asked to preside over the impeachment because the President is no longer the sitting President.

The Constitution requires the involvement of the chief justice only when the president is on trial. Since Trump no longer is president, there is no requirement for the chief justice to be involved.

Newsweek found no evidence that Roberts refused or was even asked to preside over the trial, nor does he have any legal obligation to do so.

The chief justice is required to preside over impeachment trials involving only sitting presidents.



Impeachments are political proceedings, not criminal so there are no physical punishments like incarceration or fines if convicted.

If still sitting in office, there are two political punishments.

1- Removal from office
2- A ban on ever holding office again, if the majority votes to do so

These punishments are two separate votes.

- If a former office holder the political punishment after conviction in an impeachment trial is limited to #2, Ban on holding office again.
