There are several things that have been added to the shadow docket without actually being brought before the court officially. The shadow docket was originally for emergency rulings on things that needed to be cleared up. But it has almost always been abused by the majority, whether the majority has been liberal or conservative, to add things to the courts docket that have not officially been brought to the court. And because the court alone dictates the shadow docket and does not have to publicly disclose it, they can pretty much get away with it whenever they want

The shadow docket should have been banned a long f****** time ago. The court should not be allowed to hear any case that has not been heard by a lower court. They should not be allowed to pick and choose specific things that they want to rule on that have not been brought them as part of an appeal.

scotus has ruled that federal courts cant prevent the executive branch from exceeding its authority.

The list of things that the supreme Court is allowed to have original jurisdiction over is very small. They are supposed to function primarily as the final appeals court. The Constitution places specific limits on when and where and how they are allowed to hear cases that have not been adjudicated by a lower court.

The shadow docket itself was never supposed to be used for cases that have not been heard by a lower court. It was supposed to be strictly for cases such as a lower Court needing immediate clarity on a constitutional matter or other such issues that might arise where timing does not allow a full briefing and argument s before the court it was never intended to allow the court to simply pick and choose cases they want to hear.
