The photographer serves everyone. Following the line of thought that she is just taking pictures the subject matter doesn't mean anything personal she turns no one down. What she doesn't do is advertise to same sex couples. Her website and blog contain representations of her work only of heterosexual couples. The state of New York wants her to include same sex couples as representations of her work. The state may not compel commercial speech. It's that easy.They have the same recourse as the original photographer had. GO OUT, START YOUR OWN BUSINESS AND SERVE THE POPULACE THAT YOU DESIRE. If that populace is lucrative then your business will thrive, if not.... The photographer has the right to serve whoever she so desires.^^^ Exactly. The big question then is how much of a support system can the same gender couple community have the ability to acquire?
