The Democratic Party will stop at NOTHING to prevent Trump's re-election. Anything legal or not, unscrupulous or not, there is no low they will not sink to. All their talk of election integrity is BS, they'll harvest as many illegal ballots as they possibly can and if they lose they'll unleash an army of lawyers to fight the result all the way to the SCOTUS. My gut feeling is that the DC Court of Appeals would be the last stop, and they would side with the Dems cuz that's the way that court is constructed right now. So, if the SCOTUS splits 4-4, then the DC CoA ruling would stand.

So, whether Trum's nominee is confirmed or not by election isn't such a big deal; the real issue is if that person is confirmed before the election question hits the SCOTUS. Cuz then 9 judges would render a decision rather than 8 judges splitting 4-4. I frankly think that is exactly what Roberts would want, whatever the lower court ruling is.
