I am in no way defending what he did or saying they he shouldn't have been fired.

I don't know how the UK treats dismissals, etc., but I could see this going his way.

I worked for a company years ago who lost an unemployment hearing. We had an employee who had commited theft against us. We fired him when we discovered the theft. He filed unemployment and we lost.

Their reason for allowing the unemployment claim?

We didn't state in our Employee Handbook that theft would result in termination.
