The U.S Justice Department has now taken the position that the State of North Carolina seeks to impose an UNCONSTITUTIONAL burden on its trans-gendered citizens - particularly in connection with state-funded educational institutions - by compelling them to use the gender-based bathrooms that are appropriate for their sex-at-birth. Implicitly, therefore, the U.S. Justice Department DEMANDS that the State of North Carolina accede to the declared gender of its students, regardless of "plumbing."
Aside from the fact that this is totally preposterous, I wonder if they have given this even (as the lawyers like to say) "a scintilla of thought."
Are the educational institutions of North Carolina (and hence, the other 49 states and the District of Columbia) compelled to recognize the "gender identity") of:

- a young man who wants to be a "short-skirt-and-pompom" cheerleader?
- A 6'4" young man who tells a college womens' basketball coach that he considers himself a girl and wants to play for her?
- A girl-boy who wants to join the boy's swim team?
Why? Seriously. Why?
