Newsom Threatens Parents with Penalties for Hiring Tutors

While Governor Gavin Newsom issues directives closing schools across the state, he’s also stepping up enforcement on a new law that imposes stiff penalties on parents who hire tutors to teach their students at home.
A coalition of parents, teachers and education advocates led by KOGO’s Carl DeMaio and his statewide political action committee Reform California is calling on Governor Gavin Newsom to immediately SUSPEND the law in question (AB-5) as it relates to at-home tutors and teachers.


Under a new law (AB-5) that went into effect January 1, 2020, parents who hire tutors to work at home would have to pay them as employees, not independent contractors. AB-5 imposes still penalties on any business or individual caught violating the onerous law.

I'm equally disgusted by progs, and while Newsom is certainly a prog he is unique on the progressive scene today because he tells the truth, even when it violates Progressive canon, he accepts responsibility and he doesn't blame shift. Folks like that have the ability to learn from their errors.

AB 5 law signed last year requires certain workers who previously would have been considered independent contractors to be paid and given benefits as employees. The state does not include teachers or tutors on its list of workers who are exempt from AB 5.


According to AB 5, a worker is an independent contractor if he or she is free from the direction and control of the hiring entity, does work that is outside the hiring entity’s normal scope, and has an established independent business.

In most cases, tutors working for parents would meet those requirements.

If a parent hires someone to essentially be a nanny and babysit and tutor their children in their home, then that would likely involve other employment laws outside of AB 5.
