Very little of what's in court documents can be relied on to be truthful. Affidavits under penalty of perjury are at best half truthful.

There is so much boilerplate that's required to be in legal documents that relying on them for facts is impossible.

Nope - CNN requested the divorce papers, and the guy at the county courthouse called up the retired clerk, who told the current clerk where he could find the documents from that period.

Last week, CNN obtained the folder containing the filings from the 1980 divorce, after initially being told that the divorce documents were sealed. The folder had been stashed away for years in a Carroll County, Georgia, court clerk's drawer.

Retired clerk Kenneth Skinner told CNN his deputy took Gingrich's file out of the public records room around 1994, "when he (Gingrich) became the center of attention," because Skinner feared tampering and theft.

"During these years, you had to make sure those papers were there," Skinner said. "People could go in those files and get things out. We didn't have enough security to control it."

Current Carroll County Clerk of Court Alan Lee said he called the retired deputy clerk, who told him where to find the papers, after CNN began looking for them last week.

The documents, and interviews with people close to the couple at the time, contradict the Gingrich claim about who wanted the divorce.

Newt Gingrich filed a divorce complaint on July 14, 1980, in Carroll County, saying that "the marriage of the parties is irretriebably (sic) broken."

Yet Newt was the one who filed for divorce. If her mother wanted the divorce, why didn't she file for it? When Jackie responded to Newt's divorce filing, she petitioned the court to REJECT the divorce. Furthermore, you're devolving into kettle logic. First it was that the divorce was mutual. Now, it was Jackie who wanted the divorce. These arguments are inconsistent with each other, much less the facts.

The court documentation clearly shows that Newt initiated the divorce and that Jackie did not want it.

Unpaid bills agreed to be paid by any final decree had her attorney filing that petititon. That is as common a practice as there is in a divorce case. Without an order for temporary support and child support the initial petition has to have that language as an answer by a defendant. Without it no Judge can grant any final decree. If the answer has her AGRREING to the divorce, even if she did so verbally as his daughters have stated many times, then she has NO claim to challenge a granting of the temporary support and child support by a Rule Nisi hearing by the Judge. This was manuevering by her attorney to SET THAT IN PLACE BEFORE the Rule Nisi as most Judges want that. Additionally, it was handled that way and she was satisfied with the support.
Much ado about nothing.
