New Mexico Court Rules Gas Stations Liable for Selling Fuel to Drunk Drivers

That can't be real.

If someone comes up and uses a card at the pump and gets gas and leaves how is it the stations responsibility?

If they go inside does that mean stations have to give a breathalyzer?

I see all it taking is one court case to go before a jury and it be thrown out before the law is revoked.

Knowingly. That’s a pretty short distance from should have know. Or even may have suspected.

Some drunks can still pump gas and walk easily, the attendant is too far away to see the other clues, such as slurred voice, red eyes, heavy alcohol breath and such.

You seem unaware that the small stores have walls blocking the view of some of the pumps and busy handling customers in the store to look at all.

Go try it yourself, go look through solid walls, divine behavior of people in a split second while handling the duties and the customers in the store.
 
Obviously, the real responsible parties here are Ford, Chevy etc.....................if they didn't sell cars there wouldn't be drunk driving.
 
This is the camel getting its nose under the tent phase. Next comes known / SHOULD have known, followed by reasonable means to ensure the customer wasn't intoxicated and then employee training to identify intoxicated patrons, notifying police of suspect customers...

When I was training to be a bartender, I was taught what to look for; those "tells" that always give up someone who's had too much.

Are we going to teach gas station attendants how to spot intoxicated drivers?

Yeah, a clerk telling a drunk he can’t have gas is going to go well.
 
Breaking: New Mexico rules tire shops are liable for selling tires to drunk drivers. Also quick lubes and that homeless guy on the offramp who runs up and cleans your windshield.
