Fascinating legal question. I'd argue that international humanitarian law (and thus "human rights") is formed from conventions or treaties to which individual states agree to abide by and from customary actions which become the norm. The limitations are the lack of requirement to sign on to the conventions and the lack of enforcement.

International Humanitarian Law concerns itself exclusively with the rules attacking armies must observe when it is anticipated that noncombatants may be injured or killed in an attack. It does nothing to affirm noncombatants have any rights at all, since if the rules of war are observed, the attack may proceed and the noncombatants may be killed.
As far as I know, there is no legal basis for affirming human rights exist. They would seem to be aspirational rather than real as in: in a better world, each human being would have these rights.
