EEOC wins discrimination case for Muslims fired for not delivering beer

oct 22 2015 The Equal Employment Opportunity Commission won $240,000 in damages for two Muslim truck drivers after it sued their former employer for religious discrimination for firing the drivers for refusing to make beer deliveries.

The EEOC said that Star Transport Inc., a trucking company based in Morton, Ill., violated their religious rights by refusing to accommodate their objections to delivering alcoholic beverages.

The case involved Star Transport's firing of drivers Mahad Abass Mohamed and Abdkiarim Hassan Bulshale, both of Somali heritage, in 2009 after they refused to make beer deliveries for the company, citing their adherence to Islamic law. For devout Muslims, consuming or even being in contact with any alcoholic beverage is prohibited

The EEOC argued that the company could have easily reassigned the drivers but did not and sued it for religious discrimination. Star Transport admitted liability in March. The jury awarded Mohamed and Bulshale $20,000 each in compensatory damages and $100,000 each in punitive damages. The judge awarded each about $1,500 in back pay.

Sure, employer shouldn't have hired people who wouldn't do their jobs. But he did. Consequently he assumed the difficulties of devout employees and has to pay for it.

Should serve as a lesson 'don't hire reliigously devout people if their faith will interfere with their work.' Any number of way sto avoid hiring such people. :)

We have gotten to the point where one person's butthurt is more equal than another person's butthurt. It's what happens when laws like this are not used to fight actual economic harm, but hurt feelings.

In the case of these truck drivers, to me, if the trucking business is not majority alcohol shipping, and there is the ability to make an accommodation, the company should do it. If, however, the business has a significant alcohol delivery component, and the drivers knew about it, then they should probably have found another place to work.

$250k for a fine, however, is crazy.

The question is 1) was alcohol delivery part of the job when they started, and 2) how much of a % is delivery of alcohol.

If, however, the business has a significant alcohol delivery component, and the drivers knew about it, then they should probably have found another place to work.

This is more along the lines of my reasoning concerning this case. If the business can make a reasonable accommodation for their religious employees than they should attempt to do so, reasonable being the key word. If Star Transport's primary cargo is booze than they should find another job. A stripper can't take a job and than claim taking off their clothes violates his or her religious beliefs. lol
 
Muslems refuse to do the job they were paid to do and are fired and a jury calls it (religious?) discrimination and awards them compensation. A court clerk refuses to marry sodomites and she goes to jail. Alcohol consumption wasn't legalized by the Supreme Court last month. The muslem drivers must have accepted the responsibility when they took the job. Double standard? You bet your ass(ets).

Are you saying these muslims told the company before they were hired that they would not haul beer? You're gonna have to prove that.
