No part of my post said that they couldn't file the suit and petition the government. I asked "What part of the United States Constitution, Amendment the Fourteenth, Section 2 is confusing?"

That doesn't mean they can't ask.

Some have been trying to get citizens only counted for years, even decades. But that is in direct conflict with the Constitution plain text. Wanna change it? Amend the Constitution.

The Constitution says that all people must be counted. It says nothing about citizens. The Constitution does use the word citizens in it so clearly they are delineating between citizens and non-citizens.

They will need to be sure that it gets before the SCOTUS inside of two years, three if they are waiting for a decision.

Otherwise, if they win the case, it will not affect the next census count.

It is also vital that Thomas reire so that Trump can at least get a nominee on the bench before the election later this year to ensure that a change in the census will have the best chance to succeed.

Hmm...., perhaps that can be re-interpreted by SCOTUS, amended by both Houses of Congress or the Convention of States

That is a red herring argument. The real issue is permanent vs. temporary residents. Illegal aliens, like tourists and diplomatic officials, are NOT permanent residents if they don't have a Green Card.

Your post is a dead fish. There is nothing to prevent the AG from filing the lawsuit, despite your disapproval.

To you? The 14th Amendment was designed to nullify Article 1, Section 2 of the Constitution with respect to its provisions regarding "all other Persons" (slaves). That same term was used to ensure that the provisions of the 13th Amendment (ending slavery) were fully implemented in all the states.

There was no intent to include temporary residents in the census for the purposes of determining the apportionment of Representatives among the various states.

That' your opinion. The courts have said differently. And no matter how much you right-wingers whine because you falsely believe non-citizens only vote Democrat, the fact is, if non-citizens are voting, non-citizens will vote for people of each party.
