As I understand the Constitution, Milley would have had to have actually called in order to come anywhere near committing treason. Further, Congress had not declared war on China.

Problem is, you don't understand the Constitution. It doesn't require a declaration of war. The war clause in that section is about Milley levying war against the United States - like delivering weapons to the Taliban to be used against Americans. But China is an enemy and Milley gave them aid and comfort. They slept better because they knew the President had been neutered by Milley's own actions. All the strength that Trump had shown for years had been undone.

The FBI said that there was no evidence of a "coordinated" attack. That does not mean that
