Man Who Wrote 14th Amendment Explains Who It Included… This Is Going to Devastate Liberals
Following the release of presidential candidate Donald
Trump’s proposed immigration policies, a national debate has been sparked regarding the 14th Amendment to the Constitution and the idea of birthright citizenship.
Many have argued that the 14th Amendment infers automatic citizenship upon any person born within the United States, even if the person’s parents are in the country illegally.
This has led to the use of the term “
anchor babies” to describe such persons, as the citizenship they are granted upon birth acts as an anchor to keep the family from being deported, despite their lack of legal status.
But that simply isn’t what was intended by the 14th Amendment, as proven by the words of the very man who authored the amendment in 1866, Michigan Sen. Jacob M. Howard.
Howard explained in writing exactly what the scope of the law was when he introduced it, making it quite clear that it was referring to granting citizenship to the recently freed slaves only, not foreigners or even Native Americans.
According to The Federalist Papers Project, Howard wrote, in part, “that every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States.”
But Howard continued, “This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the government of the United States, but will include every other class of persons.”
The 14th Amendment was created to confer citizenship upon only the former slaves who had recently been freed during the Civil War. It was not intended to be make a citizen of any person who just so happened to be born on U.S. soil to foreign parents in the country, legally or otherwise.

Actually, Howard explained it VERY CLEARLY.
ALL children born on our soil ARE usa citizens, unless they are born to foreign/alien Ambassadors/diplomats who are not subject to the jurisdiction of the USA and have diplomatic immunity while staying here. (with the exception of Native Americans)
He could not be more concise or clear in his words imo.... he was VERY SPECIFIC, everyone born on our soil is an American citizen, unless their foreign/alien parents have diplomatic standings giving their own foreign/alien Country, jurisdiction over them.
It means they are not citizens of another country. Diplomatic standing for another country is a hurdle you made up. Why would we offer citizenship to children of criminals but not children of diplomats? That makes no sense
NOPE....not a hurdle that i made up....this is something that our nation worked with....diplomats and ambassadors that had diplomatic immunity in the foreign nation they visited, where if here for diplomatic purposes, we had no jurisdiction over them.... we WANTED it this way, so that our diplomats and ambassadors for foreign Nations could not have a foreign nation hold our diplomats captive in their countries if our diplomats somehow broke their laws.....ONLY THOSE FOREIGNERS, the Ambassadors and Diplomats visiting the USA, are NOT under the jurisdiction of USA Laws....NO ONE ELSE.
Howard was SPECIFICALLY speaking about foreigner/alien diplomats/ambassadors to the US, that we had NO JURISDICTION over, we could not hold them to USA laws, we have to ship them back home to their foreign country....
Howard had NO REASON to write this the way he did, if it were ALL FOREIGNERS....he simply had to state all foreigners/alien children are not citizens if born here.
it was specifically directed towards the foreign/alien ambassador children that are born here...........drum roll.....because they are the ones that have diplomatic immunity and are NOT under the jurisdiction of the USA....
He specifically stated the children of foreign/alien ambassadors.....are not citizens if born here...
He DID NOT SIMPLY SAY Ambassadors, he was specific to say foreign/alien ambassadors so that he was not including our own USA Ambassadors, (that we send to their countries).
I don't know how Howard could be any more CLEAR, than what he was....?
And as others have mentioned, ALL foreigners visiting or living here, are under the rule of law, of the USA unless Ambassadors/diplomats from a foreign Nation who have diplomatic immunity....the illegal Mexicans would NOT be illegal if we had no jurisdiction of law on our own land...an illegal alien murderer could not even be held, if we had no jurisdiction of law over them....
