It was the original intent of the Framers that citizens’ rights and protected liberties were not to be considered the spoils of political war.
That although one’s political faction might have lost an election, was voted out of office, and no longer in control of the levers of political power, he needn’t fear for the loss of his rights and protected liberties, safeguarded from majority rule by the Constitution, its case law, and the courts.
That original intent of the Framers has long been abandoned, citizens’ rights and protected liberties are now subject to the capricious whims of political warfare – indeed, our protected liberties are no longer protected – where today democracy itself is under attack and imperiled.
