Trump invoked the 1798 Alien Enemies Act to deport those people to El Salvador. The problem with this is that the Act didn't cover this situation.

As to the actual deportation question...

Go back and re-read the Alien Enemies Act...

"...or any invasion or predatory incursion is perpetrated, attempted, or
threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event..."

The President issued the public proclamation after formally and legally linking the gang to the Venezuelan government.

The approach taken was that of "invasion" or "predatory incursion"... if one doesn't work, the other will.

Personally I see the latter (predatory incursion) as the easier of the two to defend in the law courts, but that's just me.

And the Law doesn't even require an actual event... merely the THREAT of one... and POTUS gets to make that "call"...

No...the Administration had it's I's dotted and their T's crossed before they did this one... :cool:

The legal conditions for the action were addressed and satisfied in advance of the action actually being executed.

Besides... those gang-members were here illegally... which makes their disposal all-the-more desirable to most Americans.

They figured-out a way to blow past you-and-yours in such matters so that they were unassailable in the law courts...

No, "persons" and "citizens" are not synonymous in the U.S. Constitution. The Fourteenth Amendment defines citizenship as applying to "all persons born or naturalized in the United States". While all citizens are persons, not all persons are citizens.
