The other side of the window Ashli was crawling through was vacant.
The shooter was in a barricaded off alcove, with just his arm sticking through the barricade, and too far off to Ashli's left for her to be able to see.
Nor did he give any warning or say anything before shooting.
Nor is it legal to shoot unless you actually see an imminent deadly threat.
If this cop is not prosecuted, then it would be legal to shoot all police on sight, since they all could then be a deadly threat.

He shot her in the front shoulder according to the medical examiner, not a direct shot to the head or heart or neck as rumors claimed.

Of all the issues surrounding the insurrection, the death of this idiot must be the least important.
She was not an innocent bystander, she was an active participant.

An active participant in a protected political protest.
It is a US tradition back in the founder's time, to do torchlight parades to the town square, where standing politicians would then be hung in effigy.
Due to the lack of media coverage, this was about the only way to achieve an equivalent.
The fact the protestors were wrong about the election makes no difference.
Wrong ideas have to be given the same opportunity to be heard as the ideas that happen to be correct.

The only thing I would add is that the cops with rifles and helmets in the stairway were not on their way up.
They were there the whole time, and there are some videos where they can be seen waiting.
So why the 2 cops blocking the door moved to the right, could only have been because they were told all the congress members had cleared the lobby, so there was no longer any need to hold the doors.
And since that was the case, then the cop that shot was committing senseless murder.
In fact, since the cops moved to the right, they were behind Ashli in the shooter's line of fire, and if he has missed Ashli, he could easily have killed one of these cops. So it was a VERY bad shot. Totally unnecessary and very dangerous.

FYI, this was investigated...I believe it was the Senate, and everyone involved said, including the cops on the stairs, that they were waiting to change spots with the guards, in front of the door.....

I saw the spurting blood, and it was only 1 inch or so from the neck.
He had to be aiming at the neck.
It is hard to get the vertical exact, but the horizontal trajectory is very easy to do.

The cops in the stairs were there for some time.
The cops at the door were minimal equipment and only 2.
There were at least a dozen down the stairway, with full armor, helmets, rifles, etc.
Since the cops at the door at the top of the stairs deliberately abandoned the post and the cops on the stairs remained stationary, it appears as if they were deliberately encouraging people like Ashli to breach the doors.
Why would 2 unarmored cops wait to exchange places with a dozen fully armed and armored cops only 20' away?
Then why move away from the door barricade completely, with no reaction from the stairway cops?
