Lawyer: Capitol Cop Who Shot Ashli Babbitt 'Ambushed' Her on Jan. 6 Without Warning

he's a bad shot...he lost control of the gun as he fired. This said, this wasn't a legal shooting and he should be in prison for murder.
It didn't look like he lost any control of his weapon....where do you get that from?

The video I saw, showed him pointing his gun at the door and window closest to himself where the rioters were slamming and banging the window they were trying to smash open.... Then a split second later ...he turned the gun to the farther broken door window that Ashli was crawling through, and fired.

There was no deadly threat that would have made the use of deadly force justifiable.

Babs was obviousy and clearly in the process of trying to overthrow the government of the United States, and in that venture, she attempted to breech a secure area of the capital in her lust to attack the Vice President and Speaker of the house. She got exactly what she deserved; good riddance!!!!! Bigly!!!

One does not need a job description.
In a democratic republic, all rights are supposed to be equal, and based entirely only on inherent rights of individuals.
That means you can switch around different individuals and roles, to see if an action is legal.

And while I disagree with the protestors, they believed a crime had been committed in the election process, and that they were acting as the police.
The guard who shot had no more authority than a janitor at a bowling alley.
Being a cop does not create any additional authority at all, and the capital is no more sacred than any private business.

The Speaker Lobby where Babbit was trying to enter is NOT a "secure area".
It is normally open to the public.
Nor could she have attacked anyone from there since Congress had left the building before then.
She also had no weapons or means to attack anyone.
While I think she was totally wrong in her beliefs, what she was doing was legal and right according to what she believed had happened previously.
So anyone killing her without a clear need, is guilty of murder according to law.
There is no way around that by pretending she had some different motive.

If you had watched the videos, you would have seen that the last of the lawmakers had left, and that is why the 2 cops blocking the barricaded door, stepped aside and let Ashli though.
There was no longer anyone to protect.
And we also know there was no risk to the legislators, because after the shot was fired, the AR armed police stormed up the stairs.
That means they were always there if they had been needed.
They were never needed.

Obviously Ashli's intent was to publicize what SHE thought was illegal election fraud.

Babbitt may be foolish, but did not deserve to be murdered.
There are many videos.
This one shows the Speakers Lobby is empty, and all the legislators had left, as well as showing the helmeted and AR armed cops were all waiting down stairs if there was any risk, at any time.



There are other videos showing that the 2 cops were successfully blocking that door until they decided to step aside, likely because their ear radio told them the last of the legislators were gone.
And if you look at the trajectory of the shooter, those 2 cops who had stepped aside, were directly in the line of fire.
If the shot had missed Ashli, then likely it would have been the cops who would have taken the hit.
Point being that shooting is always foolish, wrong, illegal, and dangerous, unless you face a lethal threat and there is no choice.

In the video of Babbitt's death, you can hear protesters saying, "THERE'S A GUN!" "HE'S GOT A GUN!" and you can see the officer clearly pointing it at Babbitt. It is not possible to hear if the officer is saying anything through the thick glass from the vantage point of the person who made the video, but if he was, Babbitt had to have heard him.

And the way he is gesturing, it looks like he is shouting at her before firing the fatal shot.

The officer claims he was screaming at her, "PLEASE STOP! GET BACK! GET BACK! STOP!"

If you assault a branch of government and are breaching the last barricade between the mob and members of the House of Representatives, and you ignore several warnings from a cop pointing a gun at you, try not to die with a surprised look on your retarded face.

The problem with that is the officer, who had duly warned the crowd violently destroying the barrier specifically erected to prevent them from injuring, killing, or kidnapping legislators -- or their staffs -- reasonably perceived he and his charges were in mortal danger.
How could he not?

  • After the crowd had been warned.
  • A gun brandished.
  • The gun aimed.
  • And Ashli shrouded in a concealing cape...still leaped towards the officers.

Her motives are really quite irrelevant in terms of getting shot.
It was her actions that got her DOA.

The determinant thought....is not what she was thinking.

Rather, it is the reasonable perceptions of the official and authorized law enforcement personnel that she was an imminent and dangerous threat to them and to the legislators and staff they had taken an oath to protect.

So, though it would make for a rude, and painful bumper sticker, it is still true:
Ashli is dead because of Ashli.

Who cares. She wasn't supposed to be there. He did his job but sadly not enough of it.
 
The signs, barricades and broken glass wasn`t a warning that she`s not supposed to be in the Capitol building? They all deserved a bullet.
