Kilmar Abrego Garcia, who was deported to El Salvador, is on his way back to the U.S. to face criminal charges - human trafficking. He's been indicted

First, he isn't a human trafficker. This is the issue. He is innocent until proven guilty.

So its good to see the Trump administration do the right thing (even though many said it would never happen) to get his day in court.

If he is found guilty he should go to prison and deported after his sentence is served.
The issue of course …..as always has been the left portraying the guy as a father and a bulls fan …..forget about his controversies though including his own wife calling the cops for domestic violence.

There was no deportation order. He had an order of protection preventing him from being sent to El Salvador, which Trump violated.

Yes there was a valid deportation order, he was illegal and lost his aslylum claim

The deportation order did however say he had legit claims of fear from a rival cartel and ordered his deportation anywhere but home. That was missed 6 years later. A federal court, the scotus, ordered that the Trump admin make easier his return and follow the order correctly

They have, he’s back in the United States under federal indictment for his terrorist activities. The only question now is do they prosecute him or deport him again

As for the domestic violence claims, his wife dropped those charges and they reconciled. Sorry, relationships are messy and shit happens.

Let's bottom line this. Trump screwed up. He admitted he screwed up, but said, "Whoops, too late now, El Salvador has him!" The Courts did their job and told him, "Nope!" Then he tried to throw everything against the wall. "Oops, he was a wife beater because the cops broke up a fight once." "Oops, he's a gang member, because we have this fake picture someone clusily photoshoppped." "Oops, he's a human trafficker because he gave some guys a ride to a job site once."

Eventually, this will be heard by a court and found to be bullshit, but not after Trump drags this shit out for years hoping we all forget about it.

Correct the deport order is still there, he’s still an illegal

1) prosecute him for the indictments, then deport him.
2) deport him to a third country (right now)
3) or go back to the immigration court and highlight the threat no longer exist, and deport him back to his home.

No third country is going to take him, and the fact that El Salvador threw him into the nastiest prison they could find deflates the argument he wouldn't be in peril if returned there.

So Trump's only path forward is to hope he can get a conviction on the bogus human trafficking charge. But more likely, he just hopes to drag this thing out for years to make it go away.

I think you are.
1) the fact he's married to a US citizen isn't relevant
2) cite the code section in the immigration law that requires a conviction before deporting an illegal....he's already been found deportable by an immigration judge for being here illegally.
3) I do agree, finding a third country to take him might be hard given his status as a terrorist, but we can certainly ask. South Sudan has been willing to take some violent criminal illegals already. The fact someone is wanted for crimes in their home country isn't part of the equation. The issue was, and why the judge gave him the protection from going home, was because of threats from a rival gang, that threat doesn't exist anymore. He could of course make another claim.

They took him only after Trump gave them 15 million dollars.
