Nowhere in any US law does it say that “expedited removal” constitutes due process.

Then why would a judge put a “hold” on his deportation based on the fact that a rival gang would kill him? That means he was in a gang.

You have it backwards. The argument was that because he was in a gang, he couldn’t be deported.

If he wasn’t in a gang, there would be no justification for the hold on deportation.

None the less, the Trump regieme is entirely responsible for snatching someone entitled to due course under the law, and railroads him to a dangerous (and possibly lethal) fate.

This is not what Americans do. It is flagrantly contrary to both our laws and Constitution.

The really bad thing about it is that the Supreme Court was ambiguous enough to allow him to skate accountability.

Now, Trump will defy the rule of law and the Supreme Court, and rule by decree (Executive Order), just like the dictator he always wanted to be.

If the government has evidence to present it, they should. That’s the normal procedure.

I'm sorry, I need to correct this statement.

There is no right to enter the country illegally, and remain. When it comes to immigration and naturalization the Constitution (Article I, Section 8) provides the power to Congress to define the laws. (Laws that the Constitution requires the President to faithfully execute (Article III, Section 3).

So Abrego Garcia entered the country illegally around 2011, was detained in 2019 and applied for asylum because he was running away from gangs trying to force him to join. Judge Davis in 2019 invalidated the asylum request because of it not being timely submitted (IIRC is has to be within one year, his claim was 7 years or so out of date). The Judge did find he could be deported, however he placed a hold on the deportation to prevent him being deported to El Salvador where his life was in danger if he were returned.

All the Trump administration had to do was comply with 8 USC 1231 (law passed by Congress) and locate a 3rd country (not El Salvador) that would accept him, then file a motion with the judge to have the hold lifted and deportation could continue.

Since sending Kilmar Armando Abrego Garcia even by accident was illegal, it voids any contract until the violation of law is corrected by returning Kilmar Armando Abrego Garcia.
