Furthermore, let’s say they indict him for any crimes related to his possession of classified documents. They have the burden of proof. But he offers Kash to show that he had declassified them. Then the Government’s burden becomes to disprove it beyond a reasonable doubt. That’s an almost impossible mission.

What other alternatives do they have?

1. They can’t indict him at all for anything that doesn’t involve classified materials because the Presidential Records Act is NOT a criminal statute. And they can’t even go after him on “obstruction” because there is no such thing as obstructing the investigation of a non crime.

2. They could opt not to even attempt to indict him. That would be the fair and logical and reasonable and just choice. But, I have my doubts that they concern themselves much with such notions when it comes to former President Trump.

Being classified or not on the possible charges listed on the warrant, it matters not on classification, but on other criminal things where charges could be brought could be totally avoided by Trump IF HE REALLY DID, declassify.
