Chief Justice John Roberts has ignored his oath to uphold the US Constitution in his asinine decision to side with the liberals in the recent case involving freedom of religion.


Justice Gorsuch did a number on the decision of the virus rule:

“This is a simple case. Under the Governor’s edict, a 10-screen “multiplex” may host 500 moviegoers at any time. A casino, too, may cater to hundreds at once, with perhaps six people huddled at each craps table here a similar number gathered around every roulette wheel there. Large numbers and close quarters are fine in such places. But churches, synagogues, and mosques are banned from admitting more than 50 worshippers — no matter how large the building, how distant the individuals, how many wear face masks, no matter the precautions at all. In Nevada, it seems, it is better to be in entertainment than religion. Maybe that is nothing new. But the First Amendment prohibits such obvious discrimination against the exercise of religion. The world we inhabit today, with a pandemic upon us, poses unusual challenges. But there is no world in which the Constitution permits Nevada to favor Caesars Palace over Calvary Chapel.


Senator Cruz tweeted the Gorsuch reply, adding “Justice Roberts has abandoned his oath."

Fortunately, most intelligent, aware people are immediately able to identify and understand the gravity of their positions at such a level and behave accordingly.

The linked article is blind-partisan rightwing idiocy.

And Chief Justice John Roberts has indeed maintained his oath to uphold the US Constitution, given the fact that the Supreme Court determines what the Constitution means.

In this case the 5-4 decision is perfectly Constitutional with regard to religious liberty.

What integrity is it that casinos can have hundreds of people in them but a church can't?

Just because the scotus ruled on it does not make it right. Scotus has gotten it wrong many times in the past, including this violation of freedom of religion.

A few thoughts on this.

We don't really know why Roberts voted the way he did. However, on an earlier similar case he indicated that the Scotus has no business interfering in decisions elected officials make. He also indicated that in his opinion churches are places of public assembly rather than businesses...and that it is ok to have different 'emergency' regulations for them.

So on one hand it looks as though Roberts is supporting states rights yet on the other he seems to feel that the constitution favors the rights of gamblers over the rights of church goers. I don't hold either against him and in the case of the former can even say that he is consistent with the principle that elections have consequences and the voters should be the ones who mete out punishment to elected officials who make unpopular or unfair decisions. In a way, it could be said that he is reining in the power of the justice system.

That said, I agree with the dissenting opinions of the 4 opposed.

I think that the churches of Nevada should use this opportunity to show the governor what peaceful protest and civil disobedience look like. Open the churches - have parishioners wear facemasks and implement social distancing. If your church holds 1500 - open it to 750. Let the governor send in state police to arrest hordes of church goers dressed in their Sunday best and singing Amazing Grace. The optics will be stunning.
