Justice Department indicts former FBI Director James Comey for a second time

Meaning this is not about lying to Congress, the DOJ can't refile in that case. They may proceed with an appeal, but they can't bring a new indictment. Why:
  • The original statute of limitations has expired. (5-years)
  • In Federal court if a case is dismissed without prejudice, they can reindict withing a 6 month window. The case was dismissed on 11/24/2025. 6 Monthis is 05/24/2026, so the reindict date is now past.
The only option is to pursue appeal of the 11/24/2025 dismissal.
