Judge Sweeney says aliens must be given 21-day notice before deportation under Alien Enemies Act

I’m not a fan of the SCOTUS making up shit on the fly, either.

By even if (for practical reasons) some “due process” is demanded, even the SCOTUS didn’t say 21 days.

If a “reasonable” amounts nt of time is required (which would any a matter I have major qualms about), it still isn’t up to SCOTUS to legislate that amount of time.
To expect 700 immigration judges to handle more than 20 million cases, it would take them more than 70 years with each handling 1 case a day, seven days a week which of course they never work seven days a week or 365 days per year. That simply is not reasonable in light of a major migrant invasion of our country even when the government illegally and maliciously facilitated that. Even if they handled three cases a day which would be a stretch given all the legal maneuvering and technicalities, we are still looking at more than 20 years to send all the illegals home.

That is what the Biden administration has forced onto us. We need a remedy more effective and efficient than what the Democrat controlled courts want to allow.

Plus, if we focus first on the illegal aliens who have proceeded to commit additional crimes once here, we can swiftly get them kicked out. Then we can turn to the less urgent cases.

It will still take decades to eject all the illegals at the rate we are going.
 
The left simply wants to stop everything that Trump is trying to do, and in this case they are going against everyone's best interest in trying to stop each and every illegal from being deported.
They weren't concerned about 'due process' when Clinton and Obama deported millions of illegals. Don't believe them for a second when they are now concerned about due process. They are completely full of shit.

It has had four years to send migrants home and for the most part has mostly not done so. And the courts are doing everything they can to prevent President Trump and his team from deporting anybody. The critics cite the large number of migrants deported under Biden. But do not cite the enormous number--millions and millions--of migrants Biden invited, facilitated, allowed into the country.

The fact is, under Section 2 of the Alien Enemies Act, those charged by “complaint” are entitled to the process outlined within Section 2.

What Judge Sweeney suspiciously avoids to note in her written opinion is, under Section 1 of the Enemies Alien Act, the President is delegated an extraordinary power totally separate from aliens charged by “complaint” under Section 2, and it includes an unobstructed discretionary deportation power to classify, apprehend, restrain, secure and remove, aliens deemed, as stated in the President’s Proclamation, to pose a threat to the general welfare of the United States and her citizens.

With respect to Section 1’s extraordinary power, the only process which may be due an alien when secured for deportation is a writ of habeas corpus, and it would be limited to determining whether or not the subject in question is in fact an alien and not a citizen of the United States.

It's so stupid to say to illegals, we give you a 21 notice you will be deported and then you can't deport them because they have flown the coup.
