Judge rules deportation was “an illegal act”

As long as they got the opportunity to exercise the guaranteed Rights to Due Process, I am good with deportation.

The fact of the matter is...

The statement
"(illegal) non-citizens don't have "due-process rights" until after their hearing and they are given temporary status." does not hold water....

Simply not true, the Right to Due Process is not based on a "hearing or "temporary status"

ArtI.S8.C18.8.7.2 guarantees Due Process Rights to any persons in the USA.
SCOTUS has ruled, are you now unwilling to follow the law?

Simplifying on what we both agree on, from YOUR post #414
"return to Mexico to await their asylum hearing in U.S. immigration court."
Correct

Let's re-examine YOUR original claim

The statement "
"(illegal) non-citizens don't have "due-process rights" until after their hearing and they are given temporary status."

does not hold water....

I am, and I do.

OK, if it makes you happy for me to say "I was wrong" about due process rights, fine.
My main point was illegals get deported first, and get their hearing much later, like in 10-years.

GREENBELT, Md. (AP) — A federal judge on Friday ordered the Trump administration to arrange for the return of a Maryland man to the United States after he was mistakenly deported to a notorious El Salvador prison, while a U.S. government attorney was at a loss to explain what happened.

The US must return a Maryland man mistakenly deported to an El Salvador prison, judge says

U.S. Immigration and Customs Enforcement expelled Kilmar Abrego Garcia last month despite an immigration judge’s 2019 ruling that shielded him from deportation to his native El Salvador, where he faced likely persecution by local gangs.

Before she issued her ruling, U.S. District Judge Paula Xinis described Abrego Garcia’s deportation as “an illegal act” and pressed Justice Department attorney Erez Reuveni for answers, many of which he didn’t have.

Now we're getting somewhere.
Justice prevails... happy day.....

The SC has agreed with the lower court ruling.

And on 4/10/25 the Supreme court in a 7-2 order supported her decision and that it would remain in effect. Alito and Thomas desented. Which means Kavanaugh, Gorsuch, and Coney Barrett (all Trump appointees) agreed that the core decision with the District Court was justified.

"The application is granted in part and denied in part, subject to the direction of this order. Due to the administrative stay issued by The Chief Justice, the deadline imposed by the District Court has now passed. To that extent, the Government’s emergency application is effectively granted in part and the deadline in the challenged order is no longer effective. The rest of the District Court’s order remains in effect but requires clarification on remand. The order properly requires the Government to “facilitate” Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador. The intended scope of the term “effectuate” in the District Court’s order is, however, unclear, and may exceed the District Court’s authority. The District Court should clarify its directive, with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs. For its part, the Government should be prepared to share what it can concerning the steps it has taken and the prospect of further steps. The order heretofore entered by The Chief Justice is vacated. (Detached Opinion) Statement of Justice Sotomayor, with whom Justice Kagan and Justice Jackson join, respecting the Court’s disposition of the application."

What, exactly, does the upheld order to "facilitate" Abrego Garcia's release from custody require someone to do?

If the deportation is allowed to stand what prevents more extralegal deportations at the whim of the regime if they can do so without accountability to the law?
You seem to be all over the gov't's attempts to thwart illegal alien LAWBREAKERS. Don't you feel that those ILLEGAL ALIENS have an accountability to the law? You are a traitor to the US and should be arrested and given due process before being punished for your crimes against the nation's populace.

The Court has no such right to demand anything of a Sovereign country and it's citizens

The Supreme Court can definitely tell the Tremendous Sovereign Nation of El Salvador to send one of their own citizens to America. But they don't have any means of enforcing that decree.

Do libs really think that American mums want to see their sons self off to die in the jungles of El Salvador trying to rescue and bring back to America a wife beating, human trafficking Gangbanger, who isn't even a citizen of this country?

If that's the hill they want to die on, who am I to say they shouldn't. But IMHO, they should have picked a more sympathetic face of their movement, maybe fellows who like to dress up like broads and do upshirt photography for the pervert community?

Their not. The demands are on the President not the other country.

Just off the top of my head the President can take actions soley within the US to facilitate the return.

#1 Hold payments of the $6,000,000 for the contract for El Salavadors human storage facilities. That is an action of the US Government, not El Salvador.

#2 Place a 100% import tarrif on El Salvadoran imports. That is an action of the US Government, not El Salvador.

#3 Place a 100% export tax on US goods bound for El Salvador. That is an action of the US Government, not El Salvador.

#4 Have the State Department put out a travel notice recommending US travelers stay out of El Salvador to target their tourist revenue. That is an action of the US Government, not El Salvador.

How else would you suggest the problem be approached?

Garcia is a citizen of El Salvador and a criminal, safely locked up in an El Salvadorian prison.

What would America say if the Iranian Supreme Court ordered the US to turn over anti-semite American Robert Bowers to their country?

Similar situation.

Trump picks up the phone and says send him back.

"Yes - OK thank you appreciate it good working with you."

"No - Well there is something called The Art of the Deal so we can continue to support you, or we can change the deal. Here are some of our options..." (then see Post #436.

The most powerful man in the world who is supposed to take on China, Russia, Hamas, Iran, etc. - can't make a deal with a 3rd world dictator?

Maybe he's not the right man for the job.

Bukele isn't a "dictator" at all.

Further, it is the courts, not President Trump who is in charge of this deal.

Trump is satisfied with having a human trafficking , wife beating MS 13'er behind bars in El Salvador.

He isn't willing to give El Salvador anything at all to have Garcia deported to America.
