No rational person would see that meme as threatening.It's not only about the post with the Trump meme. It was a series of posts culminating in a meme about a school shooting which many construed as a veiled threat.
And even after he was informed that the sheriff was getting calls about it, he left it up anyways. The prosecution can use that fact as evidence that he was aware that his posts were being construed as a threat by the public.
However, I haven't actually read their new law that he is being charged with violating. So I can't say how relevant that is regarding his guilt/innocence.
