For what prosecutable crimes was Smith investigating Republican Senators?

Those are the questions that Jack Smith will be asked at his transcribed interview. He will not be given a chance at a public forum where he can simply run out the clock for five minutes with each senator.

After the senate staff lawyers have gone over him with a fine toothed comb, then the Senate may grant him his public hearing.

My guess is that he either dodges questions or takes the fifth in both places. if so, he should give his soul to Jesus, because his a** will belong to Pam Bondi.

Attorneys for former special counsel Jack Smith called his actions "entirely lawful, proper and consistent with established Department of Justice policy" in defending the investigative steps taken by his team, including obtaining phone records of sitting Republican lawmakers as part of the probe of President Trump's efforts to overturn the 2020 election.

Earlier this month, Republican Sen. Chuck Grassley, who leads the Senate Judiciary Committee, published a document alleging that the phone data from eight GOP senators and one Republican House member were obtained by the FBI as part of Smith's investigation into efforts by President Trump and his allies to overturn the results of the 2020 election.

In a letter to Grassley dated Monday, Smith's attorneys Lanny A. Breuer and Peter Koski wrote that they are "compelled to correct inaccurate assertions made by you and others concerning the issuance of a grand jury subpoena" for the lawmakers' phone records, rebuffing criticism from GOP lawmakers that the FBI "tapped" the lawmakers' phones and "spied" on their communications.

The records, which the FBI analyzed in 2023, enabled investigators to see basic information about the date and time of phone calls but not the content of the communications, the senators said. The senators' phone data that investigators scrutinized came for calls made between Jan. 4 and Jan. 7, 2021, and was obtained by Smith through a grand jury subpoena, the senators said.

Great news for Smith! As long as he gets a jury made up of attorneys who worked with him on the investigations and his own personal attorneys, he has very little chance of being convicted.

“The subpoena’s limited temporal range is consistent with a focused effort to confirm or refute reports by multiple news outlets that during and after the January 6 riots at the Capitol, President Trump and his surrogates attempted to call Senators to urge them to delay the certification of the 2020 election results.”

The Smith attorneys note that toll records of then-President Joe Biden were obtained by special counsel Robert Hur in the probe of his mishandling of classified documents, and in the investigation of Sen. Bob Menendez, a New Jersey Democrat who was convicted on bribery and foreign influence charges.

“Mr. Smith’s use of the toll records as Special Counsel was lawful and in accordance with normal investigative procedure,” the letter from Smith’s attorneys says.
