I don't know where you get this.

The court filing specificfally says that it's it petitioning Judge Chutkan to dismiss the charges "without prejudice" as the dismissal equest is based on DOJ policy pertaing to sitting Presidents and NOT the merits of the cases. (Both DC election interference and Espionage documents case.)

Yup….and Trump was a sitting president, and Smith charged him anyway with a fake case to hurt his election chances. The case was dismissed because it never should have been brought at all.

OTOH, what Smith did was not as president, since he never was president. He is liable for malicious prosecution and election interference.
 
Nobody will prosecute Smith.

And as reprehensible as he is and his conduct has been, nobody should. He has (and even a prick like him should have) prosecutorial immunity.
 
He's well known for taking the law and applying it under his own interpretations and loses quite a few doing that. I think his track record is on Wiki.

I know it is tempting for those who have done so much evil to receive their comeuppance. There's a part of me that wants that too. But I also understand that if government weaponization against opposition is to be stopped, it has to stop with somebody. I think he has chosen for it to stop with him. And I hope there are plans to codify it into law to make it far more difficult for any future administration to do it.
The marxists tore into George Bush 43 even when George pretty much did everything the Marxists wanted, because the establishment Republicans allowed the Democrats to do it. Then the brown turd Obammy weaponized the IRS to go after conservatives and the establishment Republicans let him do it. His job as Special Counsel was perfectly constitutional. Congress wrote the laws authoritizing the AG to hire such positoins. The same statutes used by DEM and GOP administrations (including Trump) for the last 50 years.

Because he appointed a Judge that is on his short list for DC appointments and she dismissed the charges for a made up reason on the day the GOP Conventions started goes to show she was in his pocket, not that the appointment was unconstitutional.

Subordinate officers, according to the Constitution do not need Senate confirmation as long as Congress authorized their hiring. Which Congress did when it wrote the laws in the United States Code.

You missed the boat..............each individual has to be approved by congress............which never happened in this case.

The best punishment is to keep them out of power. To use the government to punish them will require millions and millions of dollars to investigate and indict and convict them with no guarantee a conviction will be achieved. And it just keeps the pattern going as 'us' doing it to 'them' will be used as justification for 'them' to do it to 'us' if they should regain the House and/or Senate and/or White House.

I prefer Trump's position on this. Yes expose them for what they are. Educate the public as to the destructive policies and initiatives they have engaged in. Embarrass and humiliate them as is justified. The majority of Americans do know how the government has been corrupt and engaged in bad acts against political opponents. But stop the lawfare and weaponization of government. Don't do it any more.

Criminals need to be arrested for the crimes they commit. There is video evidence showing the crime, not edited but real.
 
I bet they are planning on it, a case for election interference. Hopefully they can look at the E Jean Carrol case too as that was a strange one..

We'll see. I certainly don't claim any kind of crystal ball. I just know that vengeance or what appears to be vengeance can result in endless hostility. I think it is most likely time to try something else.
