Is Abortion A State’s Right Issue?

Florida Republicans are scared to death of referenda because it takes power away from the statehouse they control and puts it in the hands of the people. No state government is more anti-freedom or anti-democratic than DeSantis’ Florida. Don’t tow the party line? DeSantis is not shy about using state power to get his way. Repubs know that the abortion referendum vote will most likely go against them so they are cutting it off at the knees. The Florida Supreme Court is stacked with conservatives who will most likely strike down the abortion Referendum on some technicality. While it is not guaranteed they will strike it down, chances are greater than 50/50 they will. Let the people decide is not in the Repub playbook.

I just checked, Florida doesn’t have the initiative and referendum. The only initiative process is for a constitutional amendment or to call for a constitutional convention. So going to court to block it is the correct move. The initiative is illegal. The proper process is to elect pro-abortion legislators and vote in a new law, or propose an amendment.

Democrats like the idea of substituting ballot initiatives for the actions of the legislatures because they like to take advantage of the stupidity of the masses.

This is the kind of stuff that fascists make up to justify their tyranny of the minority.

Even fascist dumbshits understand that their "majority rule is bad, but minority rule is awesome!" position looks really awful.

So, they have to come up with a different way of justifying imposing minority tyranny. Their solution? Declare that the majority is stupid and immoral, so their wishes should mean nothing. For the good of all people, the superior conservatives ubermenschen must rule over all lesser humans.

Maybe there could be a Federal recommendation on legal abortion. Pick a number maybe 12 weeks gestation max for surgical abortion? Then after that it's only health of the mother or severe fetal issues allowed. Then let the states vote on adopting that or do their own.

The Voice of the People is BY DEFINITION codified by the actions of the legislature. We have a REPRESENTATIVE government, not a "democracy." We elect and pay our legislators to act intelligently on our behalf.

The Founders knew that the general population, acting collectively, is stupid, which is why NO SIGNIFICANT policy decisions are decided by popular vote, under the U.S. Constitution.

I think a right to an abortion is covered under the 4th Amendment but that's simply my commonsense reading of the amendment and an understanding that personhood doesn't apply to non thinking, non independent lives, even if they are human lives. That said it'll probably be a States rights issue until we get some federal legislation.

You are aware that we are a Representative Republic?
That the citizens vote for Representatives to carry out their positions, and that the general public generally does not vote on specific issues (bond referendums and such not included)
