The very first words of the constitution after the preamble are "all legislative powers herein granted shall be vested in a congress of the united states." That means only congress can write a law; not the supreme court and certainly not the president.
If the president issues an executive amnesty, he will call it an executive order but it's really a law and states need to say that it is thereby unconstitutional. According to the tenth amendment of the federal constitution, the states have authority to nullify unconstitutional federal laws.
