Even if he did lie (which he didn't do with the Muller report) he cannot proceed with a prosecution without evidence. Lying is not evidence. Opinion is not evidence. A court will not even hear a case without evidence.

Criminal prosecution requires a crime. In our system of justice, you cannot charge somebody with a crime they never committed. A good example of that was the deep stater FBI lawyer that went into files and altered them to protect the last administration. He got caught. He was charged with the crime.
