But there is a reason that many are confident that individuals involved in the riot at the Capitol will be charged on seditious conspiracy, and potentially even insurrection. The violent threats leading up to January 6, the actions taken at the Capitol, and the continued incitement of attacks on state and federal governments demonstrate a persistent and determined assault on U.S. democracy. The charges are serious and unprecedented, but so too are the violent actions that took place.




The difference, basically none because so many are spending years in prison for what they did.
 
A retired New York police officer who was also a Marine veteranwas sentenced Thursday to 10 years in prison for assaulting police in the Capitol attack on Jan. 6, 2021 – the longest sentence yet from the riot.

Thomas Webster, 56, of Goshen, New York, was convicted in a federal jury trial in May of all six charges against him, including assaulting a police officer and engaging in violence on restricted grounds with a dangerous weapon.

Webster said he was swept up in politics and former President Donald Trump's rhetoric about a stolen election but wished he'd never come to Washington.

“I should have not been there on Jan. 6 to protest the election, and I wish the events of that horrible day had never happened," Webster said through sniffles. "People would still be alive. People would not have gotten hurt. And families would not be torn apart.”

Yet, none of the hundreds of people charged in connection with that day have been charged with those specific crimes.

“Those crimes are very, very hard to prove. They require basically an intent to try to frustrate or subvert the government,” said professor of constitutional law at the South Texas College of Law Josh Blackman.

Merriam-Webster defines insurrection as, “an act or instance of revolting against civil authority or an established government.”

The dictionary also provides an ‘essential meaning’ of, “a usually violent attempt to take control of a government.”

Blackman said while the public can debate whether Jan. 6 meets the definition of an insurrection, the law is much more strict.

He said some of the people involved on Jan. 6 may see insurrection charges, but it will require federal prosecutors to prove they went to the Capitol building with the intent of overthrowing our government.

“I don’t think the government wants to bring a case unless they have a rock-solid argument in favor of insurrection,” said Blackman.

A recommendation is not the same as being the DOJ and being able to charge and prosecute people based on evidence. The same with Congress. They can recommend, but not charge.


I do not want excuses. The FBI is a weapon now aimed at political dissidents. That would be Conservatives and especially "America First" people.
 
Made up? People held for over two years without bail? Grandmother put in jail? It is reality as fascism replaces democracy.
All of these extreme distrust started with Trump becoming President and endlessly attacking the FBI. Not one previous President ever did anything even close to what Trump has done and continues to do.

The FBI conducted a search of Trump’s winter home on Monday, reportedly as part of an investigation related to classified documents.

It’s an unprecedented search. But the GOP outrage itself has been particularly sharp, referencing deeper distrust.

GOP firebrands who opposed defunding the police, such as Rep. Marjorie Taylor Greene (R-Ga.), want to “defund the FBI.”

House Minority Leader Kevin McCarthy (Calif.) said that the Justice Department “has reached an intolerable state of weaponized politicization.”
