Well here is the "official" scoop.
An employer may pay a tipped employee not less than $2.13 an hour in direct wages if that amount plus the tips received equal at least the federal minimum wage, the employee retains all tips and the employee customarily and regularly receives more than $30 a month in tips.
That being said, I have MORE of an issue with restaurants that pool their tips and split them equally. Each girl (or guy) should get their own tips.

What, specifically, is your issue with them?
If I want to sell my labor to a restaurant owner, we should be free to decide between us what the terms of the sale will be. Likewise, if I want to buy a hamburger from a restaurant owner, I don't want some corrupt politician in Washington telling us what the terms of the sale will be. Let the restaurant owner set the price of his burger, and I'll decide whether I'll buy it. Called free enterprise, or, freedom, for short.
