How Do Restaurants, Continue To Get Away With This?

Well here is the "official" scoop.

An employer may pay a tipped employee not less than $2.13 an hour in direct wages if that amount plus the tips received equal at least the federal minimum wage, the employee retains all tips and the employee customarily and regularly receives more than $30 a month in tips.

That being said, I have MORE of an issue with restaurants that pool their tips and split them equally. Each girl (or guy) should get their own tips.
I have an issue with minimum wage laws.
As do I. But if I must adhere to them... It really chaps my ass to see others get away with not doing likewise...

My tipping fluctuates depending on race, gender, creed, national origin, sexual preference, gender identity, political views, sincerity of laughter at my jokes, and the likelihood the server will have sex with me. I don't even notice the service. If my soup doesn't arrive, I tell the manager to go get it.

Likewise, if I want to buy a hamburger from a restaurant owner, I don't want some corrupt politician in Washington telling us what the terms of the sale will be. Let the restaurant owner set the price of his burger, and I'll decide whether I'll buy it. Called free enterprise, or, freedom, for short.

I worked in bar that did this and I left after a couple months b/c some people wouldn't pull their weight.

The other side of the coin is that many restaurant waiters and waitresses end up, with good tips, making more doing menial, minimum wage labor than many college graduates with degrees and education.

Yes. If I have to pay my employees a minimum wage; so should everyone. If a customer wants to give a bonus! That's their business.

then lobby your state legislature to require a minimum wage for restaurant workers. I'd support that. and while you're at it, you can lobby them to require that restaurants give paid sick days so someone with the flu isn't serving

but until there is a minimum wage for restaurant workers, I'm ok with tipping. I usually tip between 20 and 25 percent depending on quality of service. I figure if there's a minimum wage for restaurant workers, it will probably cost about the same.

I know it sounds crazy, but, there are two jobs I have always wanted..... waitress and BlackJack dealer... because I KNOW I would make a fortune in tips. I only live an hour or so from a casino, so, one of my dreams are still alive!

I paid for my degrees on the floor and behind the bar. I was very good. Too good b/c my friends always ask me make their drinks for them. I swear I spend 1/3 of any party mixing drinks for people. lol

Nothing wrong with it, you can make good money, ters wage, vs minimum wage, most will be sure you make above it, if you treat them right.If one is a cheapskate, then invariably another more than makes up the difference, usually.

Decades ago I knew of people pulling in a couple of hundred a shift easily, because they were so good.
