and that is why we are on the european path...Even the USA does not have entirely unfettered freedom of speech.
...that's just a matter of manners which is where America and europe part ways, we understand that bad taste and even malicious intent in speech is, amongst many other things, a product of poor education, but free speech in America is designed to protect unpopular speech as acceptable speech needs no such protection, so if you have the elites hauling their peasantry into court for saying something that isn't acceptable then you have no free speech, just the speech you are "allowed to have"...and that is why I said europeans do not understand free speech.And of course there is always that debate with one's conscious/tact.
While one may have the right to express a particular opinion is it always wise/tactful or even good mannered to do so?

What if the theater were empty when he yelled it? would he/she/they still be committing a crime? ...The word “falsely” does a lot of work in that sentence. Holmes was not talking about warning people of an actual fire. He was describing someone who deliberately lies in a way that triggers a stampede.

Harm and violence. Interesting. So what would be your answer to the following scenario....harm/violence is always the trump card in considering any laws, it is the closest thing to absolute freedom we can achieve without falling prey to anarchy, and we should view it as the exception that proves the rule when it comes to freedom...the rule of thumb for freedom loving peoples should always be to err on the side of freedoms.

A street corner ranter draws a crowd and vilifies a particular ethnic minority, railing that the group is corrupt, dangerous, a threat to moral values, should be removed from the country & so on.
Some members of the crowd fired by the ranter's oratory find nearby residents who are members of that ethnic group and terrorise them, set fire to their home, and savagely beat them.
Does any ethical responsibility for the actions of that group pertain to the street corner ranter?
And if you're in the US, well, you wouldn't wait for him to bleed out, just sit on his back until he dies of asphyxiation.Well clearly if I'm in the UK I arrest the dying guy for being racist to the point he bleeds out.
