"IN JANUARY 2018, A person named Jessie came to Hope Center, a faith-based homeless shelter in Anchorage, Alaska. Jessie—a biological male who identified as a woman—wanted a place to sleep after being turned away at another shelter for fighting. Hope Center only housed women at night. Having a biological male sleeping in a bed three feet away from a woman who was traumatized by domestic violence made no sense. There were other facilities nearby that sheltered biologically male clients.
3. ... Jessie filed a complaint with the Anchorage Equal Rights Commission claiming the shelter had violated the city’s anti-discrimination ordinance. The commission pressured Hope Center to accept transgender clients, but the shelter refused. Finally, in August 2018, Hope Center filed a lawsuit against the city, claiming that the city had violated the shelter’s religious liberty under the First Amendment. The complaint stated, “Hope Center believes that a person’s sex (whether male or female) is an immutable God-given gift and that it is wrong for a person to deny his or her God-given sex.”
4. It would violate the shelter’s religious convictions to house someone the center views as a man alongside women, especially female victims of violence. In September 2019, a judge issued an injunction in favor of Hope Center.
The judge didn’t rule on the religious liberty claims. The narrow ruling simply noted that the Anchorage anti-discrimination code contained exceptions for hospitals, long-term care facilities, convents, monasteries, and, yes, shelters. So Hope Center prevailed—for now."
