ABC is an FCC licensee and thus are governed by the regulations relevant for holding that license. In the end it was Disney, ABC and affiliate networks that made the decision to suspend Kimmel not the FCC. So no, this is not a free speech issue, the FCC would be well within its authority to pull ABC's license for what Kimmel said DURING THE BROADCAST, but it did not. Unlike sites on the Internet, licensed networks cannot just say whatever they want without fear of the FCC shutting them down.

.. .and Free Speech is not a "right given to us by the Constitution", it's an inalienable right granted as a product of our humanity or as expressed by our founders "by our creator", the Constitution just protects that right from interference by government. Apparently, You and Senator Kaine both suffer from the same misunderstanding as to the source and nature of human rights.

I don't know what Trump agrees with or not, nor do I care, I don't want people fired simply because of the opinions they hold (political or non-political) but what I do want is that ALL FCC licensees be held accountable to the provisions of the licenses that they signed up for.

Kimmel stepped over the line and Disney, ABC and the affiliate networks responded appropriately and thus won't face sanctions from the FCC over the matter, no violation of the first amendment has taken place, end of story.

What makes this action even worse is that Carr has been a strong proponent of Free Speech in the past, and here he goes and attacks Free Speech.

Here are Carr's comments in the past about Free Speech

In 2019 he said: "Should the government censor speech it doesn't like? Of course not. The FCC does not have a roving mandate to police speech in the name of the 'public interest'".

In 2023 he said: "Free speech is the counterweight—it is the check on government control. That is why censorship is the authoritarian’s dream".

In 2024 he said: “A lot of social media companies have embraced, or re-embraced, the idea of free speech online, I think Elon Musk and X had a great deal to do with that. I was pleased to see Mark Zuckerberg and Facebook join him, but clearly there’s more we can do.”

Now and after this suspension of Kimmel was done, this was Carr's comment" "Local broadcasters have an obligation to serve the public interest. While this may be an unprecedented decision, it is important for broadcasters to push back on Disney programming that they determine falls short of community values.
