Fox News legal expert sees “no viable case” against James Comey

Hahab geez the district court simply said there was a technically in her appointment
Halligan prosecuted Comey even though she had exactly zero authority to do so.

It’s more than a technicality. It ends the whole indictment as it violates the law, which was obvious to anyone when it all started.

It's is as if Elon Musk walked in off the street, and instructed a grand jury to indict one of his business rivals.

I never said it was criminal, as the constitution does not specify penalties, except for treason.
The poster I was replying to said her appointment was criminal

Keep up if you are gonna jump in

You are the one who claimed that a prosecutor who was illegally appointed is a criminal.

But that only applies to the other side, right fascist?

The more the real criminals get away with it, the less trust more and more citizens have in government. We are getting close to the point where in the movies where foreigners try to take over D.C. we may be on their side.

The criminal is in the White House.

Remember, he was selected to deal with only whether or not Halligan was legally appointed.
The other issues, like selective prosecution, statute of limitations etc are still before the judges in Virginia.
I told you that yesterday.

The cases against Comey, James, etc were purely lawfare. As Trump own mistakenly made public message to Bondi was telling her to weaponize the DOJ to go after Comey, James, and Schiff.

DUH !!!!!!!!
Investigating for possible criminal wrong doing?

Ok…but it’s not the criminal code
How about this one
18 U.S. Code § 912 - Officer or employee of the United States

Whoever falsely assumes or pretends to be an officer or employee acting under the authority of the United States or any department, agency or officer thereof, and acts as such, or in such pretended character demands or obtains any money, paper, document, or thing of value, shall be fined under this title or imprisoned not more than three years, or both.

Halligan falsely acted as a US Attorney.

Her appointment wasn't criminal.
But her actions while so illegally appointed, may have been criminal

18 U.S. Code § 912 - Officer or employee of the United States

Impersonating a federal officer.

Halligan received a salary (money), and subpoenaed documents (document) while pretending to be an officer of the US.
You forgot to mention being appointed unless you can tie Bondi into some kind of conspiracy theory you have nothing.

The president can prioritize criminal prosecution policy, such as going after the MAFIA.
He can't instruct the AG to go after John Gotti Jr.

That's selective prosecution.

she didn't falsely assume, she was and is an employee of the DOJ.

The question is what specifially is her job, and what authority she has in her job

All that is required is that she act as a federal officer, while not legally being one.

She was never a US attorney, but played one on TV.

That's actually a criminal violation.

18 U.S. Code § 912 - Officer or employee of the United States

But it would be up to Bondi whether or not to prosecute.

She told the judge she was a US Attorney, and not just a federal employee.

That's criminal impersonation.

I'm a federal employee, and if I pretended to be a US Attorney, I would be committing the same crime.

um a US Attorney is a federal employee.

but she never claimed to be one, she was the Acting US Attorney

There is no law or rules forbidding the practice. In fact, as head of the executive, He has the sole power to do this. All is needed is a legal basis for an investigation.
