They applaud President Obama's efforts to release terrorists out of Gitmo to regions that are beyond our control, yet the thought of concerning ourselves with securing our borders from some of the most active terrorist involved nations is racist. Slavery is banned by the 13th amendment, and is specific to any part of the US, thus negating the State's ability to defer.

Segregation and Jim Crow laws are banned by the 14th amendment, which forces the States to apply equal protection, overriding Plessey, which was a Federal judgement that allowed the States to ignore the 14th.

SSM is a unique question as it has no precedent at all, and is a major change to our understanding of the Contract. To me, the Constitution is silent on the issue, and thus it is up to State legislatures to figure it out. The one Federal responsibility is to make sure as before, all valid marriage licenses are respected in ANY State, and equal protection apply to a person with a marriage license, regardless of it meeting the State's own requirements.

If the constitution is not explicit in delegating a power to the feds, then its up to the States, period.

State's rights is not about ignoring the constitution, which would have to occur to re-instate Jim Crow Laws. The only way that would happen is if we get another Plessey type SC judgement that overtsteps the courts power, and ignores the 14th amendment.

State's rights is about letting the States manage things that are 1) Not Explicitly given to the Feds and 2) Explicitly protected as a right of the people by the Federal Constitution and incorporated onto the States as well.
