Federal Judge orders Trump to fully reinstate DACA

They both did it. No excuse for either.
We cannot allow catch and release because the illegals never show up for the court hearing

if we allow the border patrol to send illegals back the same day they arrive no children would have to be removed from the adults who brought them here

We have this thing in our Constitution known as Due Process. I understand many are not a fan of Due Process and the Constitution but you are always going to be on the losing side of that argument.

Telling a current executive he is bound by a prior executive action, which flies in the face of the entire history of our government (executives and legislatures are not bound by prior of the same).... check.

The judicial branch over stepping its authority and ordering an executive to act on a prior executive action, getting points for violating the separation of powers... check.

I think it is good for these folks caught in the middle; imagine never knowing if you would be able to stay in the country you've always lived in. The problem I see it is that allowing DACA or things like it causes major unintentional consequences. Now people know... smuggle those kids/minors in, and they can stay. Get the kids in, and now the parents can stay. So you have thousands/millions of people unloading their kids into this country. I don’t need to explain the consequences of that.

What’s to stop Pico the 18 year old from some Aztec village in central Nowhere to come over, and when he is picked up claim he was raised here and been living here since he was 5?
What’s to stop the 30 year old from getting picked up and claiming he has been here since he was 5 years old?

I understand that. I also believe in making it harder to enter this country, or remain here, illegally. It seemed reasonable to me that Trump wanted to tie DACA to additional ways to stop illegal immigration. I see nothing wrong with the Wall in strategic areas. It's an over simplistic and very expensive way to address a very complicated problem, though, the way he was proposing it.

E-Verify and REALLY prosecuting employers who hire illegals would do as much, if not more. I think the Dems should have thrown that on the table, but they won't because they all, Democrats and Republicans alike, get their contributions from big businessmen who abuse it. There is no real will to stop it.

I'm not sure what you're saying, but the only true solution to this is legislative action. Until then, the people taking the brunt of the wrath are people the least able to defend themselves, so broke they actually chanced sneaking into another country TO WORK. Oh, my.

Chad Wolf ordered the end to DACA. One problem. Chad Wolf is not legally the head of the DHS therefore any actions he takes are invalid.

So the judge isn’t legislating from the bench, he’s telling the Trump administration to follow the laws when it comes to who is and isn’t allowed to head a cabinet level department.
Trump is the ultimate head of all the cabnet departments and has the authority to end DACA

this judge is exceeding his authority
Trump exceeded his authority by appointing Chad Wolf as secretary.

Trump can end DACA but he has to do so in a legal manner. He didn’t.
