Federal District Court judge Orders Return of El Salvador Citizen from El Salvador

The federal judge overseeing the wrongful deportation case of Kilmar Abrego Garcia said she will order expedited discovery in order to "apply the law to the facts."
"The Supreme Court has spoken," U.S. District Judge Paula Xinis told the parties during a hearing in Maryland on Tuesday, five days after the U.S. Supreme Court affirmed her ruling that the government "facilitate" Abrego Garcia's return from an El Salvador prison.
"You made your jurisdictional arguments, you made your venue arguments," Judge Xinis told the Justice Department attorneys. "You made your arguments on the merits. You lost.
Its not that simple. The USSC told the district judge he's not the district that has jurisdiction over Garcia, and that the district judge can't infringe on presidential authority.
If Garcia gets a hearing date, i.e. "due process", he gets deported until then.

The Supreme Court, in a unanimous ruling, ordered the Trump regime to facilitate the release of the man it had improperly deported and is paying El Salvador to keep imprisoned.

Apparently, they are in favor of the U.S.Constitution and, specifically, the 14th Amendment being respected.

He is a citizen of El Salvador, and he is in El Salvador, end of story.

Either Trump deports them via the Remain in Mexico policy, and risk the return of gang bangers, or Trump tells Homan and Bondi to slow down and risk more needless American deaths due to the USSC allowing violent criminals to roam the USA.

The court did not order Trump to ask for the release of the the man it had mistakenly deported and is paying a totalitarian regime to keep in prison.

That is not what "facilitate" means, google it, it means: "To make easy or easier."

The "mistake" was deporting Garcia to El Salvador, which the deportation order said would endanger him from rival gangs, but Garcia is safe in prison. Garcia is a citizen of El Salvador, he is home, and he is staying there. He could have been deported anywhere else and it would have been fine per the deportation order.

Abrego Garcia is MS-13 and a wife beater, he is also in the US illegally. He had his hearing, and was scheduled to be deported, just not to El Salvador. But he is a citizen of El Salvador, he is where he belongs.

    • Abrego Garcia has not been charged with any crime. No warrants have been issued against him or his property.
    • The government has asserted ... that he is a member of MS-13...
    • The government, however, has provided no evidence, to a grand jury or to a magistrate or to any third party, that it is true.

  • If Trump corrects his admitted mistake in deporting a man with no criminal record, he can then charge him with whatever he can present evidence to document.
