One case you linked was from the Mass supreme court, which doesn't apply to NY. One was a district court in Oregon, and the other the 3rd circuit, all of which don't apply to NYC or NY State.

Only the 2nd Circuit court one applies. and that case involves a NATURALIZED CITIZEN.
