Had Clinton been charged, it would have been for mishandling classified documents and it would end up being a misdemeanor. Trump charges are most likely going be at least one felony and probably more. However, it may be difficult to convince a jury that Trump is guilty of espionage. The smoke from the gun started in Feb. 2021 just weeks after Trump left office. The NARA noticed that there were just a few boxes of presidential records when there should have been dozens of boxes and there were no boxes of classified documents. This resulted in a call to Mar A Lago. After several calls proved fruitless, the director sent a letter to Trump in May. There were calls from Trump and others that assured the NARA that they were aware of problem and working on it. In late fall there was still no shipments of documents. This prompted the director to send a letter threating to bring in the FBI if there was no action. Several months later in Jan. 2022, 30 boxes arrived.
The NARA began going through the boxes received and found 184 classified documents in 15 of boxes. The remaining boxes contained just presidential records. Many of the records were damaged, redacted, or destroyed. As the agency researched what they were sent, they found many missing presidential documents and a number of missing classified documents.
The DOJ was notified by NARA that there were many missing presidential records and classified documents. This prompted the DOJ to open an investigation in April 2022.
In the Spring of 2022, investigators from the Justice Department and FBI visited Mar-a-Lago to get more information about classified materials taken to Florida. Federal officials also served a subpoena for some documents believed to be at the estate. However, these documents not were produced.
Investigation by the DOJ confirmed via interviews that were more classified documents at Mar A Lago. However in June a Trump lawyer send a letter saying that there were no more classified documents stored at Mar A Logo. Further investigation in July confirmed that there were.
In August the court approves the search warrant. The results of the search yielded a number of boxes of president records and 6 boxes containing Top Secret, Top Secret-SCI, Secret, and Confidential documents.
The total number documents recovered by the NARA and DOJ included 184 classified documents plus the number recovered in the raid which is likely to bring the number to over 300. At least 3 dozen boxes of presidential documents were recovered. All of these documents are property of US government and were being held illegally at Mar A Lago. An FBI agent commented that the classified documents recovered in the search were not secured as required by the government.
