You confuse how a lawsuit works. If they wanted to give such evidence, they would submit it as an affidavit in support of the complaint. As such the judge admitted the evidence.
If they wanted to wait for the trial to introduce the evidence, they suffered their own peril by failing to show sufficient evidence to support their complaint.
You have to provide sufficient proof, before you go to trial to support your claim, or it gets thrown out for lack of evidence.
