What vivid recollection? She couldn't remember details from the case.

Preponderence of evidence is a level of evidence that doesn't require evidence, only that the jury reasonably feels he COULD HAVE done it. They don't even have to think he's actually guilty to get a conviction.

This is why the case should have been thrown out. When you are suing someone for millions, more than just "could have" should be required.

Also, part of me thinks this was set up. The defamation case was always waiting in the wings, because they knew trump would continue to deny it, and they would have their defamation..

The amount is even bullshit. She's suing for damages of 83 million, hell, her net worth is only 2M....where does she think her reputation was damaged enough to be 40 times her current net worth? Then she goes on Rachael Maddow show and brags about hwo she's going to spend the money....

If anyone in the court system is sane, they'll toss this travesty of a case.

This is your problem, you are fed a diet of bullshit... The case was fairly strong and Trump basically said he is allowed to sexually assault women in his deposition... that is the thing he said under oath...

It will be tossed.... It will have to go to the New York supreme Court where if they are concerned at all about their reputation they will end it.... If not it will go to SCOTUS and in my opinion it will be another 9 to Zip in Trump's favor.

Liberal judges doing even more damage to the reputation of our system of law. Judging on feelings not facts.

How did she win this case to begin with? It should have been thrown out. He wasn’t convicted of rape, not guilty on that. All he did was say she’s lying. According to the case the jury didn’t believer her either. So how the hell is she owed anything for him saying that?

The only reason it's still breathing is because it's in the hands of an extremely corrupt court system.
They know good and well once it's outside of their jurisdiction it will burn up and make them look stupid.

This whole thing sucks. It seems in this past few decades, people trash somebody who has risen to the top by claiming 30 years ago the celebrity abused them and they want the big bucks, pity, and revenge

Second Circuit Court of Appeals is a Federal Court. Next step would be review of the full court (en banc), then SCOTUS (if they would accept the appeal).
