Was your illegal hero fighting alongside the war that Timmy Walz was fighting while carrying a weapon of war?A battlefield is not the place for due process.
You’re not this stupid.

That has to change now that Biden violated our border laws. We cannot possibly investigate all the millions he let in. We need to clear a lot of them out and send them to Mexico where they can wait 5 years for their hearing. We have been invaded and need to deal with the invaders.People who have pending asylum claims are legally permitted to remain in the country until that process is completed.
The conditions in which the Jan 6 political prisoners were held were so poor that they requested to be transferred to Gitmo. Yet you never objected to THEM being thrown in a gulag, and those were American citizens. No, you reserve your tears for an illegal alien, and a violent one.A prison where people are incarcerated without basic human rights.
That’s an apt description for CECOT
Agreed. I meant the declaration. Sorry.Back to history class with you! Jefferson had NOTHING to do with the Constitution as he was in Paris as our ambassador. James Madison wrote the majority of the Constitution.
The Declaration was never intended to have the force of law. It is merely a statement.Agreed. I meant the declaration. Sorry.
and?The Declaration was never intended to have the force of law. It is merely a statement.
The January 6th terrorists brought attention to the deplorable conditions in US jails, but the inspectors actually found that their conditions were better than most of the other people in jail awaiting trial. The conditions in which the Jan 6 political prisoners were held were so poor that they requested to be transferred to Gitmo. Oh, hey BackFlush. While I usually ignore a lot of what you say, your more moderate, level headed take on due process is one I can get on board with. Good job.Nobody with a working brain gives a rat’s ass about your concern. You’re just a vermin imbecile, Dickweed.
Now, then; Back ON point:
We are all entitled to due process. But the question is always this:
What “process” IS “due” to an illegal alien?
And the correct answer is “not a boatload.”
and it has nothing to do with the Constitution because they were separated by many years under the Articles of Confederation.and?
Dickweed. Nobody with a brain gives a shit about who or what you ignore nor about who you even agree with.Oh, hey BackFlush. While I usually ignore a lot of what you say, your more moderate, level headed take on due process is one I can get on board with. Good job.
Now take a long walk off a short pier.
Who are you to deny due process? Are you making exceptions?A battlefield is not the place for due process.
You’re not this stupid.
And?and it has nothing to do with the Constitution because they were separated by many years under the Articles of Confederation.
You spend too much time cutting snd pasting the “gulag”:slogan you stole. The January 6th terrorists brought attention to the deplorable conditions in US jails, but the inspectors actually found that their conditions were better than most of the other people in jail awaiting trial.

The Crisis at the D.C. Jail Began Decades Before Jan. 6 Defendants Started Raising Concerns
The D.C. government has now promised to improve conditions at the CDF. But many argue the move comes decades too late.time.com
Not that assholes like you ever cared about conditions in US prisons before it affected people you love so dear.
They were not held in a gulag as every one of them got proper due process. They faced charges, had lawyers, access to communication, trials and sentenced in accordance with the law and constitution.
And that includes deplorable people you stick up for who beat police officers to within an inch of their lives. You shed your tears for these terrorists, but not their victims.
This is all far worse than the fate you celebrate for Kilmar Abrego Garcia and hundreds of others you want to send to a gulag without communication, without trials, without due process.
Garcia a quite a a singular case. I'm talking about your cult chanting DUE PROCESS to the point where a very deluded District Court judge has order that every single immigrant gets a hearing and every arrest has to be pursuant to an arrest warrant. She obviously is not well versed in immigration law, to be kind. The Trump Admin can't just defy or make a "mistake" on a Court Protection Order because they don't agree with it.
Under the law, the admin has to petition the Court to have this Court Order for protection removed...and it easily could have been removed by the court if the Admin could show there was no longer a threat in ElSalvador for him, and if Garcia and his attorneys could not show good evidence of a threat still existing.
And even if Garcia had his court order protection sustained, the Admin could always deport him to a different country.
The due process Garcia was not given at issue with the SC.... I think is only about Garcia getting his due process in court, regarding the above, the removal or sustaining of the Court Order for deportation protection from being sent to ElSalvador.
Follow the law. It is orderly, and for everyone's benefit in the short and long run, imho!
Proving the continuous two years is on the illegal. Not exactly.
8 CFR § 1240.8 - Burdens of proof in removal proceedings.
Once the government meets its initial burden, the burden THEN shifts to the respondent (the alleged illegal alien).
But the initial burden is on the one making the claim. The government.
Establishing the less than two years is initially on the government.Proving the continuous two years is on the illegal.
And he’s always calling people assholes. These libs get nasty when you point out their double standards. You spend too much time cutting snd pasting the “gulag”:slogan you stole.
nopeEstablishing the less than two years is initially on the government.
Once the government has met that low level threshold, then the burden shifts to the respondent.
The immigration officer is not the immigration court.nope
who have not established to the satisfaction of the immigration officer that they have been physically present in the United States continuously for the 2-year period immediately prior to the date of determination of inadmissibilit
...
When these provisions are in effect for aliens who enter without inspection, the burden of proof rests with the alien to affirmatively show that he or she has the required continuous physical presence in the United States. Any absence from the United States shall serve to break the period of continuous physical presence.
