4. Penny did not speak to Neely.

6. Penny did not warn Neely that pursuing his threats would be met with force.

He said he had reviewed Neely’s autopsy report, two toxicology reports, genetic studies, photographs from the autopsy, “a couple of videos of the incident,” psychiatric records, witness statements and transcripts of police body camera video, among other things.”

That is compelling evidence to me.

The expert witness had questions of credibility too. Dr. Cynthia Harris - the medical examiner - said this:

She told jurors earlier in the trial that Neely suffered "an asphyxial death" as a result of the chokehold. She called it "profoundly improbable" that Neely's death was due to synthetic marijuana use and sickle cell condition, which is related but not equivalent to sickle cell disease.

Within the medical examiner's office, "the consensus was unanimous" that Neely had died from the chokehold, Harris said, adding: "There are no alternative reasonable explanations."
