I don't about Texas law, but in the Commonwealth of Pennsylvania, any driver can refuse a field sobriety test. However, it is illegal to refuse a chemical test for drunkenness if you are pulled over. Its what they call "implied consent".

I'm just saying, the breathalyzer test will take
precedence. Writing the ticket for DUI while recording 2 BAC's under the legal limit on a high profile subject is a dumb move. You know how it will look, the attention it will get, the kind of law firms that will be involved and the most probable outcome. Serve and protect, don't cost your department or the public more than it's worth.
