The link I provided is based on the accounts of student journalists having the rights to release to the public, facts of the case involved.

The case involved with law blog involved an attorney representing a student and her family to a University that settled a case. In this case, I am sure a NDA was involved. So we cannot say, just because we are not privy to the facts involved in the NDA that such a scenario did not happen.

Reason and logic from the first case tells us that such cases do indeed happen. Willful ignorance or, I don't know, a prejudicial attitude toward Jones' site is the only thing that prevents us from entertaining even the possibility of the event from having occurred.
