I think it would be cool if we just followed the one we have.

There's a famous (among legal geeks) SCOTUS decision called Lopez v. U.S. It strikes down the asserted power of the federal government to regulate guns near schools. Justice Thomas, in a footnote, says, basically, "we understand it's too late in the day to actually follow the Constitution, but we can at least prevent further damage." Pretty amazing admission.
